September 21, 2016 – The 28 Day Notice of Termination is now Law!

Do yo know about the 28 day notice of termination?  The London Property Management Association has arranged for a presentation by Lawyer Joe Hoffer to discuss the newly approved 28 Day Notice of Termination Form; high-risk liabilities for landlords; and, protocols for training your staff and minimizing legal and financial risk.  The seminar takes place on Wednesday September 21.

June 30, 2016 – Feedback for future RTA Changes – eviction policies for smoking and pets
As part of its consultation process on a variety of housing related issues, the Ontario government is asking for feedback on specific issues around the eviction of a tenant for breaching a non-smoking policy.  As part of this exercise, the government is exploring whether to allow to landlords to terminate a tenancy if a tenant violates a no-smoking agreement. In these cases, landlords would not be required to prove that smoke has caused damage, impaired safety, or interfered with reasonable enjoyment. This would better support landlords to provide for smoke-free environments.
1) Should landlords be able to terminate a tenancy and evict a tenant based on violation of a no-smoking provision in a tenancy agreement?
2) Should no-smoking provisions apply to all types of smoking (e.g., tobacco, e-cigarettes)? What, if any, exceptions should apply?
3) Should the RTA specify where no-smoking provisions can apply (e.g., indoor spaces, balconies, within certain distance from residential complex)?
In addition, the govern is asking for feedback on whether to allow landlords to prohibit tenancy agreement in small buildings where the landlord also resides.

The difficulties faced by landlords is highlighted in a March 23, 2016 CTV Kitchener newscast. The article starts at time 18min 36sec into the video link clip below.  The article by Tyler Calver of CTV news highlights the plight of Ayr landlord Mary Youden and includes WRAMA director Peter Miller and Oxford County MPP Ernie Hardeman.  Mr. Hardeman understands the difficulties that can be faced by those in our industry.

The Residential Tenancies Act – Seminar – WRAMA members receive discounted rate
The Federation of Rental-Housing Providers of Ontario (FRPO) is hosting a series of seminars on the RTA in April 2016.  Seminars will be held locally in Cambridge on April 12, 2016.  The seminar series is a thorough refresher for staff and focuses on different aspects of the RTA legislation each year. This half day event features various legal experts who specialize in landlord-tenant law.  Information and a registration form are provided with the news article or at the FRPO web site (www.frpo.org).  Please note, that as a member of WRAMA, the RFPO member discount can be applied.  Please indicate that you are a WRAMA member; your membership will be verified when FRPO contacts us.

In a joint presentation at the January 2016 WRAMA meeting, Ryan King, Manager, Off-Campus Living, University of Waterloo and Tanja Curic, Policy Planner, City of Waterloo provided a summary the results of a recent Waterloo Students Accommodation study.  The WRAMA presentation can be found on the City’s Town & Gown web page http://www.waterloo.ca/en/government/townandgown.asp.  The presentation contains useful information such as the estimated surplus/deficit in housing stock, what students are looking for in accommodation and how do students find their accommodation.
